Tentative trial date set for man who shot daughter’s boyfriend

A year after a Simi Valley man was shot and killed by his girlfriend’s father, the man who pulled the trigger is still awaiting trial.
Harry Scribner, 66, shot 31-year-old Bryan Wall once in the neck in front of the Scribner home on Heavenly Court on Nov. 16, 2008, after an altercation in the driveway; Scribner says he acted in self-defense.
The trial is scheduled to begin Jan. 8 with jury selection, but that trial date is contingent upon whether a courtroom is available, according to Ventura County Dep. District Attorney Rebecca Day.
“Nothing has really happened,” Day said. “We’ve just been waiting for a courtroom and trying to line it up with all the other cases we have. If we have a room, though, we will hopefully start that day.”
The district attorney’s office originally brought up a murder charge against Scribner but then reduced it to voluntary manslaughter, a charge to which Scribner has pleaded not guilty.
The grand jury then indicted Scribner on the still lesser charge of involuntary manslaughter earlier this year. The charge carries a sentence range of six to 11 years. The gun charge adds three to 10 years.
The prosecution has said there was evidence that Scribner believed his daughter was being beaten and he committed the crime in the heat of passion.
According to Simi Valley Police reports, Scribner grabbed a handgun when he was awakened in the middle of the night by someone beating on his door.
He found his daughter, 29-year-old Jamie Scribner, and Wall in front of his house. After what police have called an “encounter,” Wall died on Scribner’s driveway of a gunshot wound to the neck.
Toxicology results showed Wall had a blood-alcohol level of 0.16, twice the legal limit for driving.
Scribner was free on $140,000 bail shortly after the incident.
